Jimmy K. FONTENOT
v.
R. LEJEUNE MACHINE SHOP & IRON WORKS, INC.

No. 88-CC-2424.

Supreme Court of Louisiana.

November 28, 1988.

PER CURIAM.

Granted. The judgment of the trial court is set aside. A suit for damages for retaliatory discharge under La.R.S. 23:1361 does not fall within La.C.C.P. art. 1732's prohibition of a jury trial in "[a] ... worker's compensation ... proceeding".

DENNIS, J., would grant the writ.

WATSON, J., dissents from the order.
