On Remand from the Alabama Supreme Court

McMILLAN, Judge.

On the authority of Ex parte Fletcher, 718 So.2d 1132 (Ala.1998), the judgment is reversed and the case is remanded to the circuit court for proceedings consistent with that opinion.

REVERSED AND REMANDED.
