Judge Coalter.

1 shall consider the tenants in this case as holding estates for the life of Mrs., Smith, as well because it is so limited by the Will, as because that limitation is perhaps not done away, or enlarged to a fee, by a charge in gross upon the land, which the tenants might he compelled to pay, at all events, whether they received profits, or not, to the amount.
