Opinion

—Judgment and order of the County Court of Rockland county reversed on the law and a new trial ordered, costs to abide the event. The action was based upon an express contract of service. It was error to charge the jury that there could be a recovery on the theory of a quantum meruit. Lazansky, P. J., Young, Cars-well, Scudder and Tompkins, JJ., concur.
