Background

The following facts were previously discussed in this court’s decision regarding defendants’ motion to dismiss the complaint, [602] also dated February 21, 2007 (motion sequence No. 1). Defendant Skanska USA Building Inc. was the “Design/Builder” of a runway at JFK Airport.
