PER CURIAM:

We granted a writ of certiorari to review the Court of Appeals’ decision in Fender v. Heirs at Law of Smashum, 354 S.C. 504, 581 S.E.2d 853 (Ct.App.2003). We dismiss the writ as improvidently granted.

DISMISSED AS IMPROVIDENTLY GRANTED.
