Fastness Trade, Inc. v. NCNB National Bank
559 So. 2d 1297, 1990 Fla. App. LEXIS 2817, 1990 WL 49835
Opinion
The trial court correctly concluded that on this record section 673.418, Florida Statutes (1989), did not afford Fastness Trade, Inc. a defense to NCNB National Bank’s claim. See National Sav. & Trust Co. v. Park Corp., 722 F.2d 1303, 37 U.C.C. Rep. 817 (6th Cir.1983); cf. Riggs Nat’l Bank v. [1298]*1298Dade Fed. Sav. & Loan Ass’n, 268 F.2d 951, 955 (5th Cir.1959) (recognizing availability of claim for unjust enrichment).
