3 N.J.L. 92
Supreme Court of New Jersey·Decided September 15, 1806·Published

Opinion

Kirkpatrick, C. J.

— In this case their appears to be no service of summons, no appearance of defendant, no hearing of the cause, but merely a judgment by default, and that entered in figures and not in words at length. The proceeding is unlawful. — The judgment must be reversed.

[*] Rossexx, and Pennington, Justices, concurred.

Judgment reversed.
