At November term, 1818, the cause having been set for hearing, on the same evidence, the Court (Thruston, J., absent.) decreed the bill to be dismissed — that being the opinion of Mor-sell, J. — and Cranch, C. J., doubting as to the conclusive effect of the decree of the Court of Chancery in Virginia.
