Opinion

The Court granted the petition for the writ of certiorari filed by the defendant McRae's of Alabama, Inc., to review its argument that the reversal by the Court of Civil Appeals conflicts with this Court's decisions holding that "It is the general rule in Alabama that absent special relationships or circumstances, a person has no duty to protect another from criminal acts of a third person." The facts are adequately set forth in the opinion of the Court of Civil Appeals. See Doe v. McRae's of Alabama, Inc.,703 So.2d 348 (Ala.Civ.App. 1996). Suffice it to say that there had never been a similar assault on the defendant's store premises, or any violent crimes of any nature on those premises. The plaintiffs' evidence falls far short of the high standard a plaintiff must meet to hold a defendant liable for the criminal acts of a third party. The judgment of the Court of Civil Appeals is therefore reversed, and the cause is remanded.

REVERSED AND REMANDED.
