Opinion
There is no substantial difference in the material facts and legal issues involved in this case and those in the case of Everitt v. Lovitt, 192 So.2d 422 (Miss. Nov. 28, 1966). For this reason, by agreement of all parties concerned, these two causes were consolidated. Therefore, this case is controlled by the decision rendered in the Lovitt case.
