Opinion

—Proceeding pursuant to CPLR article 78 (transferred to this Court by order of the Supreme Court, entered in Albany County) to review a determination of respondent Commissioner of Correctional Services which found petitioner guilty of violating certain prison disciplinary rules.

Petitioner, a prison inmate, was found guilty of violating the prison disciplinary rules that prohibit inmates from possessing contraband, refusing a direct order and possessing controlled [787]*787substances. The finding was based, in part, upon a misbehavior report which stated that petitioner was observed by a correction officer holding a mirror with a white powdery substance on it. Petitioner was ordered to surrender the mirror and powder, but he instead dumped the powder outside his cube. Two of the unauthorized items found in petitioner’s cube tested positive for the presence of cocaine. Petitioner’s guilt was affirmed upon administrative appeal, prompting him to commence this CPLR article 78 proceeding.
