ORDER Before the Court is the Magistrate Judge’s Report and Recommendation (“R&R”), whereby she recommends the Petition for Writ of Habeas Corpus submitted by Francis Enwonwu be denied and dismissed without prejudice.! Petitioner objects, in part, arguing jurisdiction remains with the United States District Court for the District of Maine.* The Court agrees. When the petition was filed, Enwonwu was incarcerated in Portland, Maine, within the jurisdictional boundaries of the United States District Court for the District of Maine.’ He filed his petition in the district court of that district and named as respondent the warden of the institution in which he was incarcerated.* “Jurisdiction attached on that initial filing for habeas corpus relief, and it was not destroyed by the transfer of petitioner and accompanying custodial change.”° Accordingly,
