Opinion

PER CURIAM.

11 Considering the unique facts of this case, we find the district court did not err in denying the exception of peremption. Accordingly, the judgment of the court of appeal is reversed, and the judgment of the district court is reinstated. Case remanded to the district court for further proceedings.
