STATE’S RESPONSE TO APPELLANT’S FIRST POINT OF ERRROR ................................................................................. 2 Examining the evidence in the light most favorable to the verdict, a rational trier of fact could have found beyond a reasonable doubt that appellant committed aggravated assault of Clifton Wallace while using or exhibiting a deadly weapon; namely: a knife.

STATE’S RESPONSE TO APPELLANT’S THIRD POINT OF ERROR ................................................................................... 21 The testimony was not hearsay because it not offered for the truth of the matter asserted. Furthermore, the statement, if hearsay, qualified as a present sense impression exception to the hearsay rule as well as an excited utterance. Finally, in light of the entire record, the admission of Warren’s testimony regarding what he yelled out to Steve, if error, was harmless.
