Opinion
Determination of the New York State Liquor Authority unanimously modified, on the law and on the facts, to the extent of dismissing Charge 1 as duplicative and reducing the punishment which we find excessive to a suspension of 15 days (CPLR, § 7803, subd. 3; § 7806; Matter of Mitthauer V. Patterson, 8 N Y 2d 37, 42) and, as so modified, confirmed, without costs. Concur — Botein, P. J., Rabin, McNally, Stevens and Steuer, JJ.
