By the Court.

In this case the justice took time to consider, *and rendered his judgment in the absence [126]*126of the defendant. He should either make a regular adjournment or give notice when he will render judgment. The justice said he would render judgment'on Monday afternoon ; but did not state the hour. This case is within the principle of the former decisions on this subject.

Let the judgment be reversed.
