Order of the Supreme Court, Orange County, entered December 10, 1974, affirmed, with $50 costs and disbursements. Upon plaintiff’s motion for summary judgment, the opposing papers raised questions of fact which could properly be resolved only after a trial of the action. Gulotta, P. J., Latham, Hargett, Damiani and Christ, JJ., concur.
