Appeal from an order of the Supreme Court, Onondaga County (John V Centra, J.), entered August 30, 2006. The order, among other things, granted defendant’s motion for summary judgment and denied plaintiffs cross motion for summary judgment.
It is hereby ordered that the order so appealed from be and the same hereby is unanimously affirmed without costs for reasons stated in the decision at Supreme Court. Present— Scudder, P.J., Gorski, Lunn, Fahey and Peradotto, JJ.
