Dwayne S. MATCHETT, Plaintiff Appellant,
v.
Blaise C. PLAGEMAN; J. E. Hodges, Defendants Appellees.

No. 93-6139.

United States Court of Appeals, Fourth Circuit.

Submitted: July 7, 1993.
Decided: Dec. 29, 1994.

Appeal from the United States District Court for the Western District of Virginia, at Roanoke. Glen E. Conrad, Magistrate Judge. (CA-92-641)

Dwayne S. Matchett, Appellant Pro Se. Reneen Evat Hewlett, OFFICE OF THE ATTORNEY GENERAL OF VIRGINIA, Richmond, VA, for Appellees.

W.D.Va.

AFFIRMED.

Before WIDENER, NIEMEYER, and HAMILTON, Circuit Judges.

PER CURIAM:

Dwayne S. Matchett appeals from the magistrate judge's order denying relief under 42 U.S.C. Sec. 1983 (1988).* Our review of the record and the magistrate judge's opinion discloses that this appeal is without merit. Accordingly, we affirm on the reasoning of the magistrate judge. Matchett v. Plageman, No.CA-92-641 (W.D.Va. Nov. 3, 1992; Jan. 13, 1993). We dispense with oral argument because the facts and legal contentions are adequately presented in the materials before the Court and argument would not aid the decisional process.

AFFIRMED.

*

The parties consented to the jurisdiction of a magistrate judge under 28 U.S.C.A. Sec. 636(c)(2) (West Supp.1993)
