The circumstances of this case are similar to those, in the case of Louisiana bank vs. Hampton,(the preceding case) an exception is taken to the opinion of the district judge given on the final decision of the case. The record contains no statement of facts nor any thing equivalent thereto.

It is therefore ordered that the appeal be dismissed at the costs of the appellant.
