Opinion
Appeal dismissed, without costs, by the Court of Appeals sua sponte, upon the grounds that (1) insofar as the Appellate Division order reverses the Supreme Court order granting defendant’s motion to dismiss the 1980 action, and denies the motion, it does not finally determine the action within the meaning of the Constitution, and (2) insofar as the Appellate Division order dismisses the 1976 action, it does not aggrieve defendant (CPLR 5511).
