AFFIRMED without prejudice to appellant’s right to raise, in a rule 3.850 motion, the denial of effective assistance of counsel for failing to properly raise and argue the unconstitutionality of section 838.021(3)(b), Florida Statutes (1985), as applied, and the legal sufficiency of the information.
