Opinion

HARRIS, Judge.

Appellee, Kenneth A. Studstill, has confessed error and joined with appellant in requesting reversal of the trial court’s order dismissing appellant’s second amended complaint with prejudice. Accordingly, the trial court’s order is reversed and this matter is remanded for further proceedings consistent with this opinion.

REVERSED.

COWART and DIAMANTIS, JJ., concur.
