Duckworth, Chief Justice.

This case being in substance the same as that of Dougherty County v. Edge, ante, it is controlled by our ruling in that case.

Judgment reversed.

All the Justices concur except Quillian, J., disqualified. Duckworth, C. J., concurs specially.
