THIS was an action of debt upon a bond assigned under seal, but without the oath prescribed by the act of 1763, c. 23. brought by the assignee against the obligor. The defendant demurred generally, and the Court (Johnson, Ch. J. and Goi.dsborougu, J.)
J. T. Chase, J. having been, counsel in this cause, previous to his appointment as judge, did not sit.
