Opinion

Order granting plaintiff’s motion to strike out the first and second counterclaims and the second and third separate defenses pleaded in the answer of defendant-appellant, unanimously reversed, with twenty dollars costs and disbursements, and the motion denied, with leave to the plaintiff to reply within ten days after service of order with notice of entry thereof, upon payment of said costs. No opinion. Present — Martin, P. J., McAvoy, Townley, Untermyer and Cohn, JJ.
