FORT, J.

This is an appeal by the plaintiff from an order entered by the circuit court quashing a writ of review obtained by him. The writ of review sought to set aside the decision of the Motor Vehicles Division of the Oregon State Department of Transportation suspending the plaintiff’s operator’s license.

After an implied consent hearing conducted in Multnomah County pursuant to ORS 482.550 (1), the Motor Vehicles Division entered its order on March 29,1971, at Salem, Oregon, Marion County, suspending the plaintiff’s operator’s license pursuant to ORS 482.540 for a period of 90 days. Although plaintiff, a resident of Multnomah County, was entitled to appeal this order of suspension to the circuit court in Multnomah County where he resides,
