By the Court,
Tbis is an appeal from tbe final decree, made in tbe preceding case. As tbe final decree was founded on tbe finding of tbe jury, tbe same reasons exist for reversing it, tbat are given for reversing tbe order made in tbat case. Tbe decree must therefore be reversed, and tbe case sent back for further proceedings.
