Opinion

COVINGTON, Judge:

For the reasons assigned in the case of "Toomer Electrical Company, Inc. v. Humble Oil and Refining Company et al.”, 321 So.2d 827, the judgment of the trial court 18 dismissing the plaintiffs suit, and assessing it with all costs for which it , can be held liable.

Affirmed.
