delivered the opinion of the court.

This motion having been brought by Dedman to subject Martin, a deputy sheriff, to the penalties of the act of January, 1811, according to the case just decided, of Caldwell against Holly, the court below correctly dismissed the motion.

The judgment musí be affirmed with cost.
