Opinion

Memorandum Per Curiam.

It was improper to summarily dismiss tenant’s counterclaim. The final order should be reversed and new trial ordered, with $30 costs to appellant to abide the event.

Hammer, McLaughlin and Eder, JJ., concur.

Order reversed, etc.
