9 10 Pro se Petitioner David Charles Bunnell has filed a petition for a writ of habeas 11 corpus under 28 U.S.C. § 2241, challenging his immigration detention at the Nevada 12 Southern Detention Center. ECF No. 1-1. He has also filed an application to proceed in 13 forma pauperis and a motion for appointment of counsel. ECF Nos. 1, 1-2, 1-3. 14 The information provided in the application to proceed in forma pauperis 15 indicates that Bunnell is unable to pay the filing fee for this action. The Court will 16 therefore grant his in forma pauperis application and grant him leave to proceed in 17 forma pauperis, without payment of the filing fee. 18 Having conducted a preliminary review of Bunnell’s petition, the Court 19 determines that it warrants service upon the respondents. The Court will order the 20 petition served on the respondents and will set a schedule for the respondents’ 21 appearance and response. 22 In addition, the Court determines that appointment of counsel is in the interests of 23 justice. See Chaney v. Lewis, 801 F.2d 1191, 1196 (9th Cir. 1986); 18 U.S.C. § 3006A. 24 The Court will grant Bunnell’s motion for appointment of counsel (ECF Nos. 1-2, 1-3) 25 and will appoint the Federal Public Defender for the District of Nevada to represent him. 26 IT IS THEREFORE ORDERED that Petitioner’s application to proceed in forma 27 pauperis (ECF No. 1) is GRANTED. Petitioner is granted leave of court to proceed in 1 IT IS FURTHER ORDERED that the Clerk of Court is kindly directed to 2 separately file the petition for writ of habeas corpus (ECF No. 1-1) and the motion for 3 appointment of counsel (ECF Nos. 1-2, 1-3). 4 IT IS FURTHER ORDERED that Petitioner’s motion for appointment of counsel 5 (ECF Nos 1-2,1-3) is GRANTED. The Federal Public Defender for the District of 6 Nevada (FPD) is appointed to represent the petitioner. If the FPD is unable to represent 7 the petitioner, because of a conflict of interest or for any other reason, alternate counsel 8 will be appointed. In either case, counsel will represent the petitioner in all federal court 9 proceedings relating to this matter, unless allowed to withdraw. 10 IT IS FURTHER ORDERED that the Clerk of Court is kindly directed to 11 electronically serve upon the FPD a copy of this order and a copy of the petition for writ 12 of habeas corpus (ECF No. 1-1). 13 IT IS FURTHER ORDERED that the FPD will have 7 days from the date of this 14 order to file a notice of appearance and indicate whether it intends to file an amended 15 petition or to indicate to the Court its inability to represent the petitioner. 16 IT IS FURTHER ORDERED that the Clerk of Court is kindly directed to: 17 1. DELIVER a copy of the petition (ECF No. 1-1) and this order to the U.S. 18 Marshal for service. 19 2. ADD the United States Attorney for the District of Nevada to the docket 20 as an interested party. 21 3.
