strike out the second separate and distinct defense and the fifth separate and distinct partial defense, as insufficient in law, and for other relief. Order, so far [555]*555as appealed from, affirmed, with twenty dollars costs and disbursements. No opinion. Present — Martin, P. J., McAvoy, O’Malley, Untermyer and Dore, JJ.; Dore, J., dissents and votes to reverse and grant the motion.
