Judgment and order reversed, on the law, and a new trial granted, wiih costs to the appellant to abide the event, on the authority of section 210 of the Civil Practice Act. (Thompson v. Whitmarsh, 100 N. Y. 35; Tilyou v. Reynolds, 108 id. 558, 566.) Van Kirk, P. J., Hinman, Whitmyer, Hill and Hasbrouek, JJ., concur.
