PER CURIAM

Writ granted. Finding there are genuine issues of material fact still in dispute, we set aside the district court's ruling which granted Occidental Chemical Corporation's motion for partial summary judgment and dismissed Texas Brine Company's fraud-based claims. This matter is remanded to the district court for further proceedings.
