On argument, order denying appellant’s motion reversed on the law and the facts, without costs, and the matter remitted to the justice presiding at Special Term, Richmond County, to take further proof on Wednesday, October 30, 1946, at ten o’clock in the forenoon, with reference to the objections presented. Lewis, P. J., Carswell, Johnston, Aldrich and Molan, JJ., concur.
