On R'emand from the Alabama Supreme Court

PER CURIAM.

The prior judgment of this court reversing the summary judgment entered by the Mobile Circuit Court (“the trial court”) has been reversed, and the cause remanded by the Supreme Court of Alabama. See Ex parte BASF Constr. Chems., LLC, 153 So.3d 793 (Ala.2013). On remand to this court, and in compliance with the supreme court’s opinion, the summary judgment entered by the trial court is affirmed.

AFFIRMED.
