In preparation for oral argument in this case, we determined the Court does not have jurisdiction to decide one of the issues. CPS Energy does not have standing to question the Commission’s declarations regarding amendments to the applicable federal regulation. (CPS Energy’s Appellant’s Point of Error No. 2; Findings of Fact 84-87; Conclusion of Law 27.) Those amendments became effective on June 8, 2011—several months after the time period for which the Commission determined the maximum allowable pole-attachment rate. That period ended with CPS Energy’s test year 2009, billing year 2010. Thus, the Court cannot review this issue.

This Court and the Texas Supreme Court have held that statements about the future are advisory and a party does not have standing to complain about them. The two attached cases demonstrate these holdings. Please provide copies to the Court.
