Appeal from an order and judgment of the Supreme Court at Special Term (Zeller, J.), entered September 8, 1983 in Broome County, which, inter alia, granted plaintiff’s motion for summary judgment declaring a vacancy in the office of Broome County Commissioner of Elections. H Order and judgment affirmed, with costs, upon the opinion of Justice Howard A. Zeller at Special Term (120 Mise 2d 1050). Mahoney, P. J., Casey, Weiss, Mikoll and Yesawich, Jr., JJ., concur.
