Fed. R. Civ. 21 P. 72(b); see also United States v. Reyna-Tapia, 328 F.3d 1114, 1121 (9th Cir. 2003). 22 23 1 Accordingly, the Court ORDERS:

3 e Defendants’ Motion for Summary Judgment, Dkt. No. 39, is 4 GRANTED. Plaintiff's amended complaint and this action are 5 DISMISSED with prejudice. 6 e The Clerk is directed to send copies of this Order and the 7 accompanying Judgment to Petitioner and to the Hon.
