As to Koopmanns: 1. Texas Natural Resources Code §91.402 states royalty “payments may be withheld without interest…when there is…a dispute concerning title that would affect distribution of payments.” Koopmanns brought a declaratory judgment claim based on their dispute with Strieber, Burlington, and ConocoPhillips over ownership of a defeasible term, non-participating royalty interest Strieber reserved from the Deed to Gilbert and Lorene Koopmann (“Strieber’s NPRI”). a. Are Koopmanns’ claims for breach of contract, unjust enrichment, conversion, negligence, and negligence per se, seeking royalties attributable to Strieber's NPRI withheld during the ownership dispute, barred as a matter of law by the Texas Natural Resources Code? b. Are Koopmanns’ claims for pre- and post- judgment interest on royalties attributable to Strieber’s NPRI barred as a matter of law by the Texas Natural Resources Code? 2. Burlington’s obligation to pay royalties for Strieber’s NPRI arises solely from its oil and gas lease with Koopmanns. a.
