Opinion

This'was an action on a promissory note of the defendant to the plaintiff, and the same questions arose upon the pleadings which were similar to those in the preceding case of Ballantine and Marsh v. Haight the defendant in each case, and the like judgment was rendered in this case.

Judgment for plaintiff.
