Opinion
The order denying the motion for a new trial is reversed as to count 2 (assault and battery by means of a dangerous weapon). The judgment on count 2 is vacated, and the verdict is set aside. The remaining convictions are affirmed. The case is remanded for further proceedings consistent with the memorandum and order of the Appeals Court.
