Opinion

BELL, J.,

This case is before the court on defendant’s motion to dismiss the charges against him. More specifically, defendant is requesting the court to dismiss the charges alleging that neither the sheriff nor his deputies possess general police powers or legal authority to make an arrest.

Upon consideration of the transcript of the preliminary hearing in the above captioned case, the briefs and arguments of counsel, the court makes the following findings of fact.
