delivered the opinion of the court.

The allegations of the bill of complaint make a case strikingly similar to that of Wilson v. Hoffman, 61 So. 699, recently decided by this court..

The chancellor evidently followed the case mentioned, when he overruled the demurrer, and the decree is threfore affirmed, and the cause remanded, with leave to ap-< pellant to answer the bill of complaint within thirty days after the filing of the mandate in the court below.

Affirmed and remanded.
