—Cross appeals from an order of the Supreme Court (Sise, J.), entered May 7, 1999 in Montgomery County, which denied plaintiffs’ motion for summary judgment and partially granted defendant’s cross motion for summary judgment dismissing the complaint.

Order affirmed, upon the opinion of Justice Joseph M. Sise.
