Concur: Judges Dye, Fuld, Van Voorhis, Burke and Bergan. Chief Judge Desmond and Judge Scileppi dissent and vote to reverse and to dismiss the complaint upon the ground that, it was impossible on this record reasonably to make a finding that this alleged fraud was not discovered until years afterwards.
