ON REMAND FROM ALABAMA SUPREME COURT

MONTIEL, Judge.

This cause is reversed and remanded to the trial court on authority of Ex parte Colbert, 615 So.2d 1218 (Ala.1992).

REVERSED AND REMANDED.
