Opinion

Order so far as appealed from modified by striking therefrom items 13, 19 and 21 and by inserting a provision permitting the introduction in evidence of plaintiff’s books and papers, and as so modified affirmed, without costs. (See Zeltner v. Fidelity & Deposit Company of Maryland, 220 App. Div. 21.) The date for the examination to proceed to be fixed in the order. Settle order on notice. Present — Finch, P. J., McAvoy, Martin, O’Malley and Townley, JJ.
